Terms of Service
Last updated /
The agreement between your business and FirstGen when you keep a website we built for you.
The agreement
These terms are an agreement between Nexus Media LLC dba FirstGen, an Indiana limited liability company ("FirstGen", "we", "us"), and the business that keeps a website we built ("you"). They cover the site, its hosting, the dashboard at app.firstgen.dev, what you pay, and how you leave. By ticking the terms box at checkout, paying for your site, or using the dashboard, you accept them on behalf of your business, and you confirm you're allowed to.
The Refund Policy (firstgen.dev/legal/refund), the Acceptable Use Policy (firstgen.dev/legal/acceptable-use), the Data Processing Addendum (firstgen.dev/legal/dpa) and the AI Terms (firstgen.dev/legal/ai-terms) are part of these terms. The Privacy Policy (firstgen.dev/legal/privacy) explains how we handle information. The Developer Terms (firstgen.dev/legal/developer-terms) will apply once we offer a public API.
What we do for you
The service. We build a website for your business from its public information (your Google Business Profile, your existing website and your photos) and show it to you as a live preview at {name}.firstgen.site. If you keep it, we host it, connect a custom domain you own, keep SSL and updates running, and make the content changes you ask for in the dashboard chat.
What a site includes. Home, services, about, reviews and contact, plus service-area information when your listing has it. Built mobile-first and fast.
What we don't do. We don't run ads, answer your phone, or sell or do your work. We don't promise rankings, calls or customers. We don't register a domain for you in your name unless we agree to help with that separately.
Who does the work. Our own team runs the service. We use the providers listed in the Privacy Policy (firstgen.dev/legal/privacy) to host and run it, and we stay responsible for their work.
Your account and the dashboard
Who can have one. A business, through a person who is at least 18 and allowed to act for it. The service is for businesses, not for personal or household use.
Signing in. You sign in with the email you checked out with and a one-time code or link. Keep access to that inbox. Tell us at support@firstgen.dev right away if you think someone got in who shouldn't have.
Keeping it accurate. Your site is only as good as what's on it. You agree to tell us, or change in the dashboard, anything on it that becomes wrong: hours, phone, address, services or prices.
Availability. We work to keep sites and the dashboard up, but they can be down for maintenance or for reasons outside our control. We don't promise a specific uptime.
The plan and what you pay
Website: $197 a month. Money back: 30 days. Term: No contract. Cancel anytime.
The preview. Looking at your preview is free, and we hold it for 14 days. Nothing is charged until you choose to make your site live at checkout. There's no free period after that.
Billing. $197 a month, charged by Stripe at checkout (day one, when your site goes live) and then at the start of each billing month, until you cancel. No setup fee, no contract.
What's included. Everything is included in $197 a month: your site with 30–150 pages for every service and town, hosting, SSL, connecting a custom domain you own, your dashboard with every visit, call and form, Google Search Console data, and content edits by chat. There is nothing extra to buy and no extra charges.
Failed payments. If a payment fails, Stripe retries for about 7 days and emails you, and your site stays up. Update your card from Billing. If it still fails, the site shows a "this site is paused" page.
Taxes. Our prices don't include sales tax. If tax applies to you, it's added to the invoice.
Price changes. We won't change your price for a period you've already paid for. Before a price change takes effect, we'll email you at least 30 days ahead, and you can cancel before it does.

Refunds
Email support@firstgen.dev within 30 days of paying and we'll refund it in full, no questions asked; your site then pauses. After 30 days, charges aren't refundable, but you can cancel anytime. The Refund Policy (firstgen.dev/legal/refund) has the details.
What you confirm
You own or represent the business. At checkout you confirm that you own the business the site is about, or are authorized to represent it, and that its name, phone number, address, photos and other listed content belong to the business or you have the right to use them.
If that isn't true, tell us at support@firstgen.dev and we'll take the site down.
Contacting people. When you call, text or email people who contact you through your site, you're responsible for following the laws on calls, texts and email, and for stopping when someone asks you to.
Playing fair. You agree to the Acceptable Use Policy (firstgen.dev/legal/acceptable-use).
What you own and what we own
Yours. Your business name, logo, photos, text and other business content, your domain, and your Google Business Profile. You keep all rights to them.
Ours. The site design, templates, layout and code, the dashboard, and our software stay ours. You can use them for your site while you're a customer.
What you let us do. You give us permission to copy, adapt and display your business content on your site, and to show your preview to you, for as long as we host it.
Reviews and photos
Reviews shown on your site are quoted from your business's public Google Business Profile, with the reviewer's public name, and attributed to Google. We don't write or alter reviews. You can remove any review from your dashboard.
Photos come from your public listing or website, or ones you send us. Tell us to remove any photo and we will. If someone else asks us to remove a photo or review they have rights in, we may remove it and will tell you.
Cancelling and leaving
How you cancel. Anytime, from Billing in your dashboard. No call and no email needed.
When it ends. Your site stays live until the end of the month you paid for, then pauses. You won't be charged again.
Refunds. Cancelling isn't a refund by itself. Within 30 days of paying, you can get a full refund on request, as above.
Coming back. A paused site (cancelled, refunded or unpaid) stays saved for 60 days, so you can come back without starting over. After that we delete it.
What you keep. Your domain, your business content and your Google Business Profile. The site design and code stay with us.
If we end it. We can end the service if you seriously or repeatedly break these terms, or don't pay. We'll tell you in writing first and give you at least 10 days to fix it, unless the problem is illegal or harmful. If we end it for any other reason, we refund the part of the current month you didn't get.
Signing up online
Agreeing. Stripe's checkout records that you ticked the box agreeing to these terms and confirming you own or represent the business, and when, so both of us can show what was agreed.
Card payments. Stripe processes every payment. We never see or store your full card number.
Chargebacks. Please email support@firstgen.dev before disputing a charge with your bank. A refund within 30 days is faster, and a chargeback can pause the site.
Your information and your visitors' information
Your business's information. How we collect and use it is in the Privacy Policy (firstgen.dev/legal/privacy).
Your visitors' information. The names, phone numbers and messages people send through your site's contact form are your visitors' information. We handle it only to run your site, under the Data Processing Addendum (firstgen.dev/legal/dpa).
No promise of results
Results depend on your area, your trade, your prices, your reviews and how fast you answer. We don't promise a search ranking, a number of calls or customers, or revenue.
Except as these terms say, the service, the sites and the dashboard are provided as is, and we make no other promises about them, to the extent the law allows.
Limits on what we owe each other
Indirect losses. Neither of us is responsible to the other for lost profits, lost jobs or indirect losses, to the extent the law allows.
The cap. The most we can owe you under these terms is what you paid us in the 3 months before the claim.
Your responsibility. You'll cover us for claims that come from content you confirmed was yours to use, from your contacting people unlawfully, or from your breaking these terms.
What the limits don't cover. Fraud, or anything the law doesn't let us limit.
Changes to these terms
We may update these terms. When we make a change that matters, we'll email you at least 30 days before it takes effect and change the date at the top of this page. If you don't agree with a change, you can cancel before it takes effect.
Indiana law and disputes
These terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules.
Talk first. If something goes wrong, email support@firstgen.dev and we'll try to fix it with you directly before either of us goes further.
Where. Any dispute that can't be fixed that way is brought in the state or federal courts located in Hamilton County, Indiana, and each of us agrees to those courts. Either of us can use small claims court instead.
If any part of these terms is unenforceable, the rest stays in force.
If we don't enforce a term right away, we can still enforce it later.
You can't transfer this agreement without our written consent. We can transfer it as part of a sale or merger of the business.
These terms and the policies they name are the whole agreement between us.
